OTD ULUSLARARASI BİLİŞİM TEKNOLOJİLERİ TEKNİK DESTEK ve DANIŞMANLIK TİCARET LİMİTED ŞİRKETİ (hereinafter be referred to as “OTD”) takes possible security measures to ensure your personal data are collected, stored and shared in accordance with the laws and protect your confidentiality.
As OTD, we aim to inform you about ways to obtain your personal data, purposes for processing them, persons we share your data with, reasons for sharing and your rights in the most transparent way in line with your satisfaction as per the “Law on Protection of Personal Data” numbered 6698.
As per provisions of the Law on Protection of Personal Data numbered 6698 and relevant regulations (“LPPD Regulations”), any kind of your information making your identity specific and determinable including your special personal data are considered Personal Data and collected by OTD as Data Controller within the scope described below and processed within the borders ordered by the regulation.
“Processing of Your Personal Data” means any kind of process conducted for data, such as and obtaining, recording, storing, keeping, changing, reorganizing, disclosing, transferring, taking over, classifying them, making them obtainable or preventing use.
1- Purpose for Processing Your Personal Data and Your Processed Personal Data:
OTD may collect personal data from parties like its customers, employees, potential customers, employee candidates, business partners and suppliers in the categories of identity information, contact details, customer information, customer transaction information, transaction security information, legal transaction and compliance information and marketing and sales information, etc.
Upon all agreements/information forms and relevant documents executed with your approval and/or signature, your personal data are collected in partly or wholly automated ways through verbal, written, video, audial or electronic channels, which are ways to contact you in the future or as a part of any data recording system with various methods, such as our company, physical environments, call centers, websites, mobile applications, Internet transactions, social media and other publicly-available media, user interviews, scan of judicial records, market information, Identity Sharing System, SMS channels, digital applications to websites, all of our mobile applications, written/digital applications to sales teams and companies providing call center service to provide special promotion, advertisement, campaign, discount, benefit, condition, pricing, advantages and other benefits, to contact you for those matters, to communicate with you for data processing needs, systematic infrastructure, requirement of data processing support services received and necessary information on those services and products, to receive your orders, to realize your payment transactions, to establish logistics cooperation with 3rd parties and send products, to recommend for interesting products and services, to provide online behavioral advertising and marketing, customer portfolio management, measurement and development of service quality, communication, optimization, audit, risk management and control, promotion, analysis, to determine areas of interest and to offer scoring, profiling, marketing, sales, advertising and communication. Such data are stored to execute agreement and fulfill legal obligations within the frame of reasons for legal compliance as specified in the law.
Your personal data collected for this legal reason may be processed and transferred within the scope of terms and purposes for personal data processing specified in the articles 5 and 6 of the Law on Protection of Personal Data numbered 6698.
2- Legal Reasons and Consent for Processing Your Personal Data:
If you have not given your consent, you will be able to give your consent by clicking and confirming consent box in consent section or at membership page of the website if we request your consent due to legal obligation.
Within this scope, your consent is requested for collecting, storing, processing, using and transferring your personal data that you share with OTD by expressing your will to benefit and hear from products and service advantages to be provided by OTD for you in order to offer you various advantages and ensure any physical and electronic communication for special advertisement, sales, marketing, survey and similar purposes and send other communication messages. You can always apply to OTD to withdraw your consent through methods you allow.
3- Personal Data Share and Transfer
In accordance with security and confidentiality principles specified in the regulation, your personal data processed by OTD may be transferred to administrative and public authorities, legally-entitled public institutions and organizations, administrative offices and legal authorities, business partners, shareholders, participations of OTD, third parties providing us with services to carry out our activities, consultants, auditors, attorneys and other third parties providing us with services, legal persons like our cooperating program partner enterprises, organizations, cooperating domestic/foreign companies, domestic/foreign companies that are our service providers/supporters/counselors or project/program partners, third parties providing us with security and call center services and support, subcontractors, independent auditors and support service providers in order to ensure legal and commercial safety of cooperating third parties and/or ensure security of electronic and physical environment and due to legal obligations and within the frame of legal restrictions.
Your personal data which may be transferred to the abroad include the following:
Identity Data: Name, Surname
Communication Data: E-mail, Telephone and Address
Visual and Audial Data: Photograph of real person
Other: Access date and time, Device identity, Operating system, Scanner type and IP address
As OTD, we may transfer your personal data to other electronic environments such as servers, hosting companies, programs, cloud computing, etc. providing storing, archiving and information technologies located in Turkey and EU countries, the USA, UK, OECD countries provided that necessary security measures are taken.
Your personal data collected may be transferred within the frame of terms and purposes for personal data processing specified in the articles 8 and 9 of the Law numbered 6698 as limited to realizing purposes mentioned above.
4- Your Rights Granted by the Law:
As personal data owners, you may deliver your requests about your rights to OTD via methods mentioned below and OTD will conclude the request as soon as possible and not later than thirty days free of charge according to the nature of the request.
However, if Board of Personal Data Protection determines a price, the amount in the tariff determined by OTD shall be paid.
As per the article 13 of the Law on PPD, it is determined that requests of relevant persons must be met by data controller free of charge and Board of Personal Data Protection is entitled to determine price to be taken by data controller if transaction requires additional cost.
Based on this, it is determined with Communique to Data Controller for Application Principles and Procedures as issued by the Board and published on the Official Gazette dated 10.03.2018 pricing shall not be applied up to 10 pages if application of related person to be replied in written, 1 Turkish Lira shall be paid for each page above 10 pages and price to be requested by data controller cannot exceed cost of said recording environment if application is replied in a specific recording environment like CD, flash disc, etc.
According to this, pricing shall not be applied for responses by OTD up to ten pages. 1 Turkish Lira shall be paid for each page above 10 pages.
Price to be requested by OTD cannot exceed cost of recording environment if application is replied in a specific recording environment like CD, flash disc, etc.
If data controller is faulty in matter of request of the relevant person regarding implementation of the Law on Protection of Personal Data, it is required to refund the price to the relevant person.
Within this scope, personal data owners have the right;
To learn whether personal data is processed,
To request information if personal data is processed,
To learn purpose of processing personal data and personal data is used in accordance with such purposes,
To know domestic and international third parties that personal data is transferred to,
To request correction if personal data is processed deficiently or incorrectly and request transaction done within this scope to be reported to third parties that personal data is transferred to,
To request personal data to be deleted or disposed if reasons for processing are eliminated although they are processed in accordance with provisions of the Law numbered 6698 and other laws and request transaction done within this scope to be reported to third parties that personal data is transferred to,
To reject if there is a result against the person when processed data is analyzed exclusively through automated systems,
To request for claim of person suffers from any damage arising from illegal processing of personal data.
You can deliver your request for use of your above mentioned rights in Turkish and in written or via registered electronic mail (REM) address, secure electronic signature, mobile signature or via electronic mail address notified to OTD and registered in our system in accordance with the paragraph 1 of the article 13 of the Law numbered 6698 and Communique to Data Controller for Application Principles and Procedures numbered 30356 and dated 10.03.2018.
Applications shall contain only information of applicant person and it is not possible to obtain information of other family members and third parties. OTD reserves the right to authenticate your identity before replying.
Your application must include;
Your name, surname and your signature if application is made in written,
Your T.R. identity number for citizens of Republic of Turkey and your nationality, passport number or identity number (if you have) if you are citizen of a foreign country,
Your residential or business address on the basis of notification,
Your electronic mail address, telephone and fax number on the basis of notification, if any,
Your subject of request and mandatory information and documents related to the subject.
According to the nature of your request, you are required to provide information and documents making identification possible to us completely and accurately.
If required information and documents are not provided properly, investigations to be made by OTD regarding your request may be completely or qualitatively suspended. In this case, OTD declares that it reserves its legal rights.
Therefore, you are required to send your application in full to include requested information and documents for identity authentication according to nature of your request. Best regards,
