OTD ULUSLARARASI BİLİŞİM TEKNOLOJİLERİ TEKNİK DESTEK ve DANIŞMANLIK TİCARET LİMİTED ŞİRKETİ (hereinafter be referred to as “OTD”) takes possible security measures to ensure your personal data are collected, stored and shared in accordance with the laws and protect your confidentiality.
As OTD, we aim to inform you about ways to obtain your personal data, purposes for processing them, persons we share your data with, reasons for sharing and your rights in the most transparent way in line with your satisfaction as per the “Law on Protection of Personal Data” numbered 6698.
Administrative and technical infrastructure required to ensure data security is established and periodically audited and updated.
Please request assurances provided by provisions of the regulation on Protection of Personal Data for other websites you are directed (via links) to by the website of OTD and review data security policy of those websites.
OTD does not guarantee security of websites that are considered third parties.
In accordance with the Law on Protection of Personal Data numbered 6698 (“LPPD”), your personal data will be processed by our Company as Data Controller to be used, recorded, stored, updated, transferred and/or classified within the frame explained below in connection with business purposes.
Within this scope, our Company takes all technical and administrative measures to provide convenient security level in order to protect your personal data against illegal processing, illegal access and keep them secure in accordance with the Laws and Regulations issued to protect fundamental rights and freedoms and personal data, especially including the right of privacy.
Target group of this text contains employees of our Company and all real persons whose personal data are processed by our Company, except employee candidates who applied to our Company for a job.
Personal data we process with the capacity of data controller contain wide variety of information including but not limited to;
Name, surname, T.R. identity number, address, telephone number, e-mail address, signature, physical location/security image records, call center/service quality voice records, bank account number, cookie records.
A) Data Controller and Representative :
Your personal data may be collected and processed by OTD within the following scope in accordance with the Law on Protection of Personal Data numbered 6698 (“LPPD”).
B) Purpose and Legal Reasons for Processing Your Personal Data :
OTD may collect personal data from parties like its customers, employees, potential customers, employee candidates, business partners and suppliers in the categories of identity information, contact details, customer information, customer transaction information, transaction security information, legal transaction and compliance information and marketing and sales information, etc.
Your personal data collected may be processed in line with requirements of the law for various purposes, including but not limited to;
To conduct necessary activities, such as determining and implementing commercial and business strategies of our Company, to carry out marketing, business development and planning activities in order to enable you and/or enterprises and organizations you represent to benefit from products and services provided by our Company,
To carry out administrative activities for communication conducted by our company,
To ensure physical security and audit of locations of our company that are currently used,
To establish business partner/customer/supplier (authorities or employees) relationship,
To meet contractual requirements and financial agreement for products and services provided with our business partners, suppliers or other third parties,
To implement human resources policy of our company,
To call customer services center or use the website of our company and/or participate in trainings, seminars or organizations held by our Company,
To ensure products and services of OTD are offered to you, price and invoice products, sell products and services, perform and track transactions you request about products and services procured and/or used, deliver and install products and carry out after-sales services for the products such as maintenance, repair, etc.
To plan and carry out customs operations, production and/or operational processes, supply chain management and customer relations management processes,
To plan and carry out call center, reception, defective product return, maintenance and repair, in-place repair and customer information systems,
To plan and carry out consultancy, maintenance, supply and reporting services,
To meet our responsibilities against you, arrange records and books and to comply with information storage, reporting, informing, tax and other obligations provided by national and international legislations,
To provide special promotion, advertisement, campaign, discount, benefit, condition, pricing, advantages and other benefits for sales and marketing activities to be carried out to enhance quality of services and products, to contact you for those matters,
To communicate in order to share necessary information with you for data processing needs, systematic structure, necessity of data processing support services received and these services and products,
To carry out traffic measurement, statistical analyses, segmentation/profiling and CRM operations for sales and marketing activities,
To measure and enhance customer satisfaction, manage complaints, receive your opinions and suggestions for new services and products, receive your fault-error notifications and inform you about products, services and your complaints and requests,
To receive your orders, perform your payment transactions, establish logistics cooperation with 3rd parties and send products to you, recommend products and services that may draw your attention, provide online behavioral advertising and marketing, customer portfolio management, measuring and enhancing service quality, provide communication, optimization, audit, risk management and control, promotion, analysis, determining areas of interest, provide scoring, profiling, marketing, sales, advertising, communication,
To provide comparative product and/or service quotation, modeling, current or new product operations and/or developments, ensuring your personal data are used for any products and services to be provided for you within the scope of the laws and relevant regulations that regulate operations written in OTD agreements as subject your explanations to OTD,
To comply with information storage, reporting and informing obligations provided by official authorities, fulfill requirements of agreements and perform legal obligations that OTD is subject to for benefiting from those services,
To manage financial operations, communication, market investigation and social responsibility activities, purchasing operations (request, quotation, assessment, order, budgeting and agreement), internal system and application management operations and legal operations conducted by OTD in order to determine and apply commercial and business strategies of OTD,
And to review, evaluate and reply requests from official authorities or you within the frame of terms and purposes for personal data processing specified in the articles 5 and 6 of the Law numbered 6698.
C) Whom and for What Purposes Personal Data Are Transferred:
In order to realize purposes mentioned above, your personal data collected may be shared with various real and legal persons, including but not limited to;
Business partners, shareholders, participations of OTD,
Persons or enterprises allowed by provisions of the Tax Procedure Law, regulation of Social Security Institution, Court of Accounts, the Law Regarding the Prevention of Laundering of Crime Revenues, the Turkish Commercial Code, the Code of Obligations and other regulations,
Legally authorized public institutions and organizations, administrative and legal authorities,
International companies and their participations,
Counselors, auditors, attorneys and other third parties providing service,
Real or legal persons that we receive service from and cooperate with for product/service comparison, analysis, evaluation, advertising and purposes mentioned above, enterprises and organizations that are program partners, contracted providers that we agree to send messages to our customers and cargo companies that deliver your orders to you within the terms and purposes for personal data processing as specified in the article 8 and 9 of the Law numbered 6698.
D) Method and Legal Reasons for Collecting Personal Data:
In OTD, your personal data are collected by OTD for execution of the agreement within the frame of legislation through applications at the contractual websites, other organizations that we receive/provide support services from/to and real and/or legal persons and vendors that we cooperate with for transactions within the scope of any kind of regulation or agreement in verbal,
written or electronic environment like short messages and electronic mails, voice mail system, our website and call centers.
In short, your personal data are collected by OTD to carry out our commercial activities through various channels and on the basis of different legal reasons.
Your personal data collected for this legal reason may be processed and transferred within the scope of terms and purposes for personal data processing specified in the articles 5 and 6 of the LPPD and for purposes specified in the articles (b) and (c) of this text.
As a method for collecting and storing personal data, your personal data that you share with our Company are collected with automated or nonautomated methods in verbal, written or electronic ways through offices, branches, call center, website, social media platforms, mobile applications and similar means.
Your personal data will be stored in electronic and/or physical environments. Necessary business processes are designed and technical security infrastructures are developed in order to ensure your personal data obtained and stored by our Company are not exposed to unauthorized access, manipulated, lost or damaged.
Your personal data will be processed with all necessary information security measures and stored and processed during legal storage period or a period required by purpose for processing if a legal storage period is not provided provided that your data are not used for purposes and scope other than those notified to you.
At the end of this period, your personal data will be removed from data flow of our Company with methods like deletion, disposal or anonymization.
E) Rights of the Personal Data Owner Specified in the Article 11 of the Law Numbered 6698 :
As personal data owners, you may deliver your requests about your rights to OTD via methods mentioned below and OTD will conclude the request as soon as possible and not later than thirty days free of charge according to the nature of the request.
However, if Board of Personal Data Protection determines a price, the amount in the tariff determined by OTD shall be paid. As per the article 13 of the Law on PPD, it is determined that requests of relevant persons must be met by data controller free of charge and Board of Personal Data Protection is entitled to determine price to be taken by data controller if transaction requires additional cost.
Based on this, it is determined with Communique to Data Controller for Application Principles and Procedures as issued by the Board and published on the Official Gazette dated 10.03.2018 pricing shall not be applied up to 10 pages if application of related person to be replied in written, 1 Turkish Lira shall be paid for each page above 10 pages and price to be requested by data controller cannot exceed cost of said recording environment if application is replied in a specific recording environment like CD, flash disc, etc.
According to this, pricing shall not applied for responses by OTD up to ten pages. 1 Turkish Lira shall be paid for each page above 10 pages.
Price to be requested by OTD cannot exceed cost of recording environment if application is replied in a specific recording environment like CD, flash disc, etc.
If data controller is faulty in matter of request of the relevant person regarding implementation of the Law on Protection of Personal Data, it is required to refund the price to the relevant person.
Within this scope, personal data owners have the right;
To learn whether personal data is processed,
To request information if personal data is processed,
To learn purpose of processing personal data and personal data is used in accordance with such purposes,
To know domestic and international third parties that personal data is transferred to,
To request correction if personal data is processed deficiently or incorrectly and request transaction done within this scope to be reported to third parties that personal data is transferred to,
To request personal data to be deleted or disposed if reasons for processing are eliminated although they are processed in accordance with provisions of the Law numbered 6698 and other laws and request transaction done within this scope to be reported to third parties that personal data is transferred to,
To reject if there is a result against the person when processed data is analyzed exclusively through automated systems,
To request for claim of person suffers from any damage arising from illegal processing of personal data.
You can deliver your request for use of your above mentioned rights in Turkish and in written or via registered electronic mail (REM) address, secure electronic signature, mobile signature or via electronic mail address notified to OTD and registered in our system in accordance with the paragraph 1 of the article 13 of the Law numbered 6698 and Communique to Data Controller for Application Principles and Procedures numbered 30356 and dated 10.03.2018.
Applications shall contain only information of applicant person and it is not possible to obtain information of other family members and third parties.
OTD reserves the right to authenticate your identity before replying.
Your application must include;
Your name, surname and your signature if application is made in written,
Your T.R. identity number for citizens of Republic of Turkey and your nationality, passport number or identity number (if you have) if you are citizen of a foreign country,
Your residential or business address on the basis of notification,
Your electronic mail address, telephone and fax number on the basis of notification, if any,
Your subject of request and mandatory information and documents related to the subject.
According to the nature of your request, you are required to provide information and documents making identification possible to us completely and accurately.
If required information and documents are not provided properly, investigations to be made by OTD regarding your request may be completely or qualitatively suspended.
In this case, OTD declares that it reserves its legal rights.
Therefore, you are required to send your application in full to include requested information and documents for identity authentication according to nature of your request.
